3. Our Contract with You
A Contract is formed when we issue an email confirming acceptance of your Order. An automatic acknowledgment of receipt is not confirmation of acceptance.
If we are unable to accept your Order, we will notify you and either no payment will be taken, or a full refund will be issued.
Each Order is assigned a unique reference number. Please use this when contacting us about your Order.
We currently only sell and deliver to addresses within the United Kingdom.
4. Our Products
Product images on our website are for illustrative purposes only. While we make every effort to ensure accuracy, actual packaging may vary slightly without affecting product quality.
Coffee is sold in 220g and 1kg bags. A weight tolerance of ±9g applies to 220g bags. Natural settling may occur during transport.
Allergens: Our coffee is roasted in the same facility as our bakery. Although we follow strict hygiene practices, cross-contamination is possible. Therefore, we cannot guarantee the absence of gluten, nuts, milk, sesame, or other allergens listed under UK food law.
5. Changes to Your Order
If you wish to amend your Order, please contact us as soon as possible. We will let you know if the change is possible and any resulting price or delivery adjustments. We will not proceed without your confirmation. Changes are not guaranteed once the Order is confirmed.
6. Changes by Us
We may make minor changes to Goods to comply with applicable laws or regulations.
In the event of significant changes to the Goods or these Conditions, we will notify you and give you the right to cancel the Contract before the changes take effect. If cancelled, you will receive a full refund for any Goods not supplied.
7. Delivery
UK delivery
We send online coffee orders with Royal Mail Tracked 48 or Tracked 24. Local pickup is also available where offered at checkout.
- Small parcels up to 2 kg: Tracked 48 £3.95; Tracked 24 £4.95.
- Parcels over 2 kg to 10 kg: Tracked 48 £7.95; Tracked 24 £8.95.
- Parcels over 10 kg to 20 kg: Tracked 48 £12.50; Tracked 24 £14.50.
Tracked 48 is free on eligible UK orders of £30 or more after discounts. Tracked 24 is free from £50 after discounts. Price-based thresholds use the merchandise subtotal after discounts and before any applicable tax. The final delivery charge is shown at checkout.
The same ordinary UK rates apply across England, Scotland, Wales and Northern Ireland. Larger orders may be sent in separate parcels, each within Royal Mail’s weight and size limits. Please contact us before ordering an oversize item or arranging a bulk delivery.
Dispatch days
We dispatch on Tuesdays and Thursdays. Order by 23:59 on Monday for Tuesday dispatch, or by 23:59 on Wednesday for Thursday dispatch.
Delivery aims and tracking
Tracked 48 aims to arrive within two to three working days of dispatch. Tracked 24 aims to arrive the next working day after dispatch. These are delivery aims, not guarantees, and some postcodes take longer.
Tracking details are provided when your parcel is dispatched. Delivery aims vary by postcode, including some remote areas and Northern Ireland. BFPO deliveries are subject to the applicable addressing, size and weight restrictions; tracking confirms handover to BFPO in Northolt and does not provide an onward delivery target.
Coffee subscriptions and gifts
Our regular monthly and fortnightly coffee subscriptions receive 10% off every delivery. Delivery charges and free-delivery eligibility are assessed for each delivery after the subscription discount.
Our three-month gift subscription is paid for once and includes three monthly coffee deliveries. It does not renew. Checkout shows the full payment and any delivery charges for all three shipments. For prepaid gifts, free delivery eligibility is based on the full prepaid coffee subtotal after discounts.
Pickup and digital gifts
Products marked as collection only cannot be posted. Digital gift vouchers are delivered by email. Digital gift vouchers have no postage charge and do not count towards free-delivery thresholds.
Problems with delivery
If your parcel is delayed, missing or damaged, contact hello@thecurator.co.uk with your order number so we can help.
For Consumers, we will deliver within 30 days of order confirmation unless another delivery period has been agreed. Your rights if we fail to deliver are not affected by the carrier’s delivery aims. Goods remain at our risk until they are received by you or a person you identify to receive them.
Delivery arrangements for Traders are agreed separately. Ownership of Goods supplied to Traders remains with us until full payment is received.
8. Consumer cancellations and returns
If you buy online as a Consumer, you can normally cancel without giving a reason by telling us within 14 days of receiving your Goods. You then have another 14 days to return them. For regular deliveries under one contract, the cancellation period runs from receipt of the first delivery. Please email hello@thecurator.co.uk with your name, order number and a clear statement that you wish to cancel.
This change-of-mind right does not apply where a legal exception applies, including Goods liable to deteriorate or expire rapidly, personalised Goods, or sealed Goods unsuitable for return for health protection or hygiene reasons once unsealed. These exceptions do not affect your rights for faulty or misdescribed Goods.
For a valid cancellation, we refund the Goods and the cost of our least expensive standard delivery option. Any extra charge for an upgraded delivery option is not refunded. Refunds are made using the original payment method within 14 days of receiving the returned Goods or evidence that they were sent back, whichever is earlier. Where no Goods were supplied, we refund within 14 days of being told of the cancellation.
You pay return postage for a change-of-mind return unless we agree otherwise. We cover reasonable return costs where Goods are faulty or misdescribed. We may reduce a change-of-mind refund for loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
Our additional 30-day voluntary returns offer, including its eligibility conditions, is set out in our Return and refund policy. It does not replace or limit your statutory rights. Faulty-Goods rights are not limited to 14 days.
Please contact us before returning Goods. The return address is The Curator, Unit Q, Scope Complex, Wills Road, Totnes, TQ9 5XN.
Optional cancellation form
To The Curator, Italian Food Heroes Ltd, 4 Haytor View, Heathfield, Newton Abbot, Devon, TQ12 6RQ; hello@thecurator.co.uk:
I/We hereby give notice that I/We cancel my/our contract of sale of the following Goods: [describe Goods]. Ordered on/received on: [date]. Name of Consumer(s): [name]. Address of Consumer(s): [address]. Signature of Consumer(s), only if sent on paper: [signature]. Date: [date]. Delete as appropriate.
9. Our Right to Cancel
We reserve the right to cancel a Contract if:
- You fail to make payment when due.
- You fail to provide accurate delivery information.
- You are a Trader and breach these Conditions or become insolvent.
We may also withdraw Goods from sale with a minimum of 30 days’ notice. If this affects an existing Order, a full refund will be provided.
10. Problems with the Goods
If there is a problem with your Goods, please contact us at hello@thecurator.co.uk.
Consumers are entitled to statutory remedies under the Consumer Rights Act 2015. Traders may rely on the Sale of Goods Act 1979.
If Goods are rejected under your legal rights, you must return them to us. We will cover return postage for faulty or misdescribed items.
11. Price and Payment
All prices are shown in pounds sterling and include VAT at the applicable rate.
If the VAT rate changes between the order and delivery date, we will adjust the VAT you pay unless you have already paid in full.
If we identify a pricing error before accepting your Order, we will notify you and give you the option to proceed at the correct price or cancel your Order.
Consumers must pay in full at the time of ordering.
Traders must pay within 14 days of invoice unless otherwise agreed.
Late payments (Traders only) may incur interest at 4% above the Barclays Bank base rate, plus reasonable debt recovery costs, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998.
11A. Coffee subscriptions and discounts
Choose your coffee and a monthly or fortnightly delivery. Save 10% on every recurring delivery, with no scheduled reduction in the discount. Payments renew automatically at your chosen frequency. Free UK Tracked 48 delivery applies when each delivery subtotal is £30 or more after discounts.
There is no ongoing minimum commitment for our regular coffee subscriptions. You can pause, skip or cancel before your next renewal through your customer portal. Pausing does not remove your 10% subscription discount when you resume.
Our three-month gift subscription is paid for once and includes three monthly coffee deliveries. It does not renew. Checkout shows the full payment and any delivery charges for all three shipments. For prepaid gifts, free delivery eligibility is based on the full prepaid coffee subtotal after discounts.
WELCOME10 is a 10% welcome offer for coffee on a customer’s first one-time online order. It excludes subscriptions and gift vouchers, is limited to one use per customer and cannot be combined with another discount. Free delivery thresholds are assessed after discounts.
12. Liability
Nothing in these Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for breach of statutory rights.
For Consumers:
We are liable for loss or damage caused by our breach of these Conditions where such loss was foreseeable. We are not liable for losses that were not foreseeable, indirect, or due to your misuse of the Goods.
For Traders:
To the fullest extent permitted by law, we exclude liability for loss of profit, loss of contracts, business interruption, or any indirect or consequential loss.
Our total liability in relation to any Order is limited to the total price paid for the Goods.
13. Personal Data
Your personal information will be processed in accordance with our Privacy Policy.
14. Other Legal Terms
We may transfer our rights and obligations under these Conditions to another organisation. You may not transfer your rights without our prior written consent.
This Contract is between you and us. No other person shall have any rights to enforce any of its terms.
If a court finds part of this Contract unlawful, the rest will remain in force.
Any delay or failure to enforce our rights does not waive them.
These Conditions are governed by English law.
If you are a Consumer in Scotland or Northern Ireland, you may bring legal proceedings in your local courts.
